RE: MOVIE RULES

Dear Brothers and Sisters:

Below are the current rules governing movie referrals which became effective October 1, 2006 and amended December, 2007. Also, enclosed is the current seniority referral list. Please remember, this is a referral list not a seniority list like one found in a Collective Bargaining Agreement with a company.

1. When there is a need for drivers, the list will be followed by seniority. The List shall be forwarded to the Captain on the show, and he in turn will call qualified individuals, by seniority. When a driver is called and not available or does not answer the telephone, the next person in seniority order will be called after a one (1) hour grace period. The only exception will be if a driver has notified Secretary-Treasurer and Principal Executive Officer Bairos one (1) week before that he or she is out of town and calls in everyday to check on his or her status.

2. There will be no light duty notes accepted. You must be available for full duty or you will not be referred. It is tough enough proving we provide good, hard-working people that are reliable and dedicated, than providing people on light duty or restrictions.

3. If a driver goes on vacation while on a job, he will not be allowed to return unless he has notified Secretary-Treasurer and Principal Executive Officer Bairos in January of that year of when he/she intends to take his/her vacation weeks (bereavement or circumstances with no control will be considered).

4. When a driver is released from a movie, it is his or her responsibility to notify Secretary-Treasurer and Principal Executive Officer Bairos at that time, and he in turn will verify with your Captain or Co-Captain your availability.

5. No one will be allowed on the Seniority Referral List if they are on a Seniority List of an active company and has worked there in the previous year. This also pertains to the Business Agents.

6. In the event "the regular" movie list is no longer frozen and the Union determines that additional employees are needed on the list, casual employees shall be added to the regular movie list upon having worked five (5) consecutive work days for an employer.

7. Employees may be removed from the regular movie list for proven misconduct as determined by the principal officer, subject to hearing before the Local Union Executive Board. Proven misconduct shall include, but shall not be limited to:

(a) Violation of the employer's work rules;
(b) Violation of the IBT Constitution, Local Union By-Laws or Local 251 film, video, and entertainment industry referral rules, as from time to time amended.
(c) Determination by Local 817 that the employee is not suitable for referral.

Please remember - this is Local 817's jurisdiction. Let's work together with them to maintain a strong relationship which will, in turn, build trust with our Brothers and Sisters from New York.

Once again, enclosed is a copy of the Seniority Referral List. Please contact me as soon as possible to make sure I have your correct telephone numbers.
